Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Nudge iOS app ("App") operated by David Maddux ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms.

1. Use of the App

Nudge is a personal goal-tracking app that uses AI to deliver motivational messages. You may use the App for your own personal, non-commercial purposes.

You agree not to:

• Reverse engineer, decompile, or disassemble the App.
• Use the App in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to our Cloudflare Worker proxy or Anthropic's API through the App.
• Use the App to harass, harm, or impersonate any person.

2. Subscriptions and Billing

Nudge offers a free tier and a premium subscription ("Nudge Premium") with monthly and annual billing options. All purchases are processed by Apple through the App Store.

• Free trial — New users receive a 7-day free trial of Nudge Premium upon first install. No credit card is required until you purchase a subscription.
• Billing — Subscriptions are billed to your Apple ID. Payment is charged at the time of purchase and at each renewal period.
• Auto-renewal — Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Cancellation — You may cancel at any time through iOS Settings → Your Name → Subscriptions. Cancellation takes effect at the end of the current billing period.
• Refunds — All refund requests are handled by Apple. We do not process refunds directly.

3. AI-Generated Content

Nudge generates motivational messages using the Anthropic Claude AI model. These messages are intended to be helpful and encouraging, but they are AI-generated and may occasionally be inaccurate, incomplete, or inappropriate for your situation.

AI-generated nudges are not a substitute for professional medical, psychological, financial, or other professional advice. If you are experiencing a mental health crisis, please contact a qualified professional or a crisis helpline.

4. Intellectual Property

The App, including its design, code, and original content, is owned by David Maddux and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App on your personal Apple devices in accordance with these Terms.

Goal data and notes you enter in the App remain your own. You grant us no rights to that content except as necessary to provide the service (e.g., generating a nudge via the AI API).

5. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Your use of the App is at your sole risk.

6. Limitation of Liability

To the fullest extent permitted by law, David Maddux shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if advised of the possibility of such damages.

7. Changes to the App or Terms

We reserve the right to modify or discontinue the App or these Terms at any time. We will provide reasonable notice of material changes where practicable. Continued use of the App after changes constitutes acceptance of the updated Terms.

8. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.
